if you get injured at work and awaiting confermation from workers comp. and then get dismissed from your job .

if i got injured at work and had a pending disciplanary hearing pending and since my injury happened at work and i would assume workers comp. would come into play could i be denied workers compensation if i were to get fired 3 days after my injury which does’nt pertain to me being terminated?

Work injury law suite?Some advise PLEASE!!!?

I have a family member that has a law suite going and could be worth a truck load of money.(This person is not sue happy they deserve it)
anyhow the lawyer on the case has only met with the victom twice,three times if you count the unsucessful mediation. He rarley checks in and it takes him weeks to return uor calls.They are set to meet agin in mid april for deposition. We dont really know much about the process, is it normal for an atourney to have so little contact with his client in such a case? How long does it normally take to actually get your day in court once you have filed the suit? We started the process last spring.There is alot riding on this and the injured cant have propper treatment untill he gets his settelment or reward because he needs a very expensive operation. Is there any way to speed this along?(sorry bad spelling)

I just received a 25% disability rating in california for my left knee. I have been on workers comp for almost two years. I cannot return to my job as a journeyman painter. I am just wondering how much can i expect for a settlement (lump sum). Also will they retrain me to do something else? i just contacted an attorney today,but do i really need him?

You probably don’t need that attorney. Benefits are strictly defined by the state – so there’s no negotiations there. The only time attorneys are any good, is when either a. the insurance company denies the claim, and don’t think it’s work related or b. you disagree with the disability rating or c. if your employer didn’t have any workers comp in force, and you have to sue them for what you’re due.

Anyway. California has one of the most convoluted and difficult calculations, when figuring a settlement. There are charts, and you have to flip between them. They take your whole person impairment rating, and adjust for your loss of future earnings, your occupation group code, your occupation group NUMBER, which is separate from the group code, and your occupational variant – different than both the number and code. That’s adjusted for your age, and VOILA! You now have the settlement amount.

So there are TONS of variants, that go into the calculations.

I am in agony beyond belief. I cannot sleep. Seems that after nearly five years, my attorney did little to develop my PI case. Did not talk to the four witnesses, did not depose the defendants (owners of the art gallery).
Then, just 6 weeks before trial, he abruptly quit. Case worth $ 175,000 to $ 200,000.
5 years ago, at an art gallery a multi-paneled art object — 4 ft by 4 ft — broke from the wall & fell on me. Suffered soft-tissue neck injury. 4 witnesses. 5 doctors.
From the start, my Attorney said, We will have to go to trial. He suddenly quit just weeks before trial. Days before trial, Case so old judge would not grant me trial continuance. I settled for less than $ 5,000. No choice. I plan to go to State Bar, then legal malpractice attorney. I was homeless, on welfare, this after working 6 years as software engineer. Lost everything I worked so hard for. Did get 100% Social Security disability. Needed compensation, though, to get back on feet.

It depends on why your atty quit. You might have a case for legal malpractice though. Proving everything is going to be tough.

Anyone ever deal with workers comp?

I was told by my attorney yesterday that I have a meeting with a vocational rehab councilor in the near future. Can I assume this is an attempt by my employer to avoid a settlement? My doc has put some pretty stiff restrictions on me limiting my ability to sit, how do they expect me to sit in a classroom?????
My disability is permanent, my restrictions are permanent, and are documented by my physician. I just find it odd that WC expects me to sit or retrain for anything with these restrictions, it’s very painful.

For those that don’t know about world history … Here is a condensed versionâ€&brkbar; Humans originally existed as members of small bands of nomadic hunter/gatherers. They lived on deer in the mountains during the summer and went to the coast or rivers and lived on fish and lobster in the winter. The two most important events in history were the invention of beer and the invention of the wheel. The wheel was invented to get man to the beer. These were the foundation of modern civilization and together were the catalyst for the splitting of humanity into two distinct subgroups: 1 . Liberals 2. Conservatives. Once beer was discovered, it required grain and that was the beginning of agriculture.Neither the glass bottle nor aluminum canwere invented yet, so while our early humans were sitting around waiting for them to be invented, they just stayed close to the brewery. That’s how villages were formed. Some men spent their days tracking and killing animals to BBQ at nightwhile they were drinking beer. This was the beginning of what is known as the Conservative movement… Other men who were weaker and less skilled at hunting learned to live off the conservatives by showing up for the nightly BBQ’s and doing the sewing, fetching, and hair dressing. This was the beginning of the Liberal movement. Some of these liberal men eventually evolved into women. They became known as girlie-men. Some note worthy liberal achievements include the domestication of cats, the invention of group therapy, group hugs, and the concept of Democratic voting to decide how to divide the meat and beer that conservatives provided Over the years conservatives came to be symbolized by the largest, most powerful land animal on earth, the elephant. Liberals are symbolized by the jackass for obvious reasons. Modern liberals like imported beer (with lime added), but most prefer white wine or imported bottled water. They eat raw fish but like their beef well done. Sushi, tofu, and French food are standard liberal fare.. Another interesting evolutionary side note: most of their women have higher testosterone levels than their men. Most social workers, personal injury attorneys, journalists, dreamersinHollywood and group therapists are liberals. Liberals invented the designated hitter rule because it wasn’t fair to make the pitcher also bat. Conservatives drink domestic beer, mostly Bud or Miller. They eat red meat and still provide for their women. Conservatives are big game hunters, rodeo cowboys,lumberjacks,construction workers, firemen, medical doctors, police officers, engineers, corporate executives, athletes, members of the military, airline pilots and generally anyone who works productively. Conservatives who own companies hire other conservatives who want to work for a living. Liberals produce little or nothing. They like to govern the producers and decide what to do with the production. Liberals believe Europeans are more enlightened than Americans. That is why most of the liberals remained in Europe when conservatives were coming to America .. They crept in after the Wild West was tamed and created a business of trying to get more for nothing. Here ends today’s lesson in world history: It should be noted that a Liberal may have a momentary urge to angrily respond to the above before forwarding it. A Conservative will simply laugh and be so convinced of the absolute truth of this history that it will be forwarded immediately to other true believers and to more liberals just to #$ %$ them off. And there you have it. Let your next action reveal your true self…..I’m going to have another beer.
